THE FLORIST FEDERAL CREDIT UNION Online Access Agreement and Mobile Banking Disclosure Statement

 

Terms and Modifications to Service                    


The terms and conditions of these services are subject to change without notification to you, unless prior notification is required by law. THE FLORIST FEDERAL CREDIT UNION reserves the right to revoke or refuse Online Access or Mobile Banking services. We may cancel your Online Access or Mobile Banking services at any time with or without written notice to you. For example (and not excluding other examples), if you do not provide us with your current mailing address, we may cancel your services until you provide us with your current address. If you believe we may not have your current address, please contact us at the phone number or address listed, or use the “address change” feature in Online Access.

 

Multiple Account Access

 

THE FLORIST FEDERAL CREDIT UNION provides members with the opportunity to view multiple accounts, access multiple accounts, and transfer between account.  Full access is provided.  When accessing this service, you agree that  1) you have full authority to view and access these accounts and 2) that you hold THE FLORIST FEDERAL CREDIT UNION harmless for any and all improper use thereof, or for any activity that may cause these accounts to be abused, overdrawn, or where fraudulent activity occurred because of your negligence or mishandling of these accounts, or where you did not follow the terms of this agreement.

 

Security

 

By using Online Access or Mobile Banking, you agree to accept responsibility for protecting the integrity of your Password and Challenge Question Answers. In order to help prevent unauthorized transactions within Online Access, you also agree to ensure the security of the personal computer (PC) or mobile device you own and/or use to access THE FLORIST FEDERAL CREDIT UNION Online Access. You also agree that THE FLORIST FEDERAL CREDIT UNION may revoke Online Access if unauthorized transactions occur as a result of your negligence in safeguarding the Password, and Challenge Question Answers; or as a result of your negligence in ensuring the security of the personal computer or mobile device you own or use to access THE FLORIST FEDERAL CREDIT UNION Online Access service, as described above. Further, you agree that if THE FLORIST FEDERAL CREDIT UNION is notified that you have included the credit union in the filing of a petition of bankruptcy, THE FLORIST FEDERAL CREDIT UNION may revoke or refuse access to Online Access service. Notify us AT ONCE if you believe your account has been accessed without your authority. The best way to minimize your possible loss is to telephone, although you may advise us in person or in writing.


Controlling Law and Users Responsibilities

 

Our web site and the electronic services that we provide (excluding linked sites) are controlled by the Credit Union from its principal office in Roswell New Mexico, which law governs this Agreement. While you may choose to access our web site and electronic services from other locations, we make no representation that any information, materials, or functions included in our web site or via our electronic service are appropriate or authorized for use in other jurisdictions.

 

Types of Available Transfers and Limits on Transfers


With THE FLORIST FEDERAL CREDIT UNION Online Access and Mobile Banking, you can make transfers between your savings and checking accounts; and from your savings and checking to pay your loans. You may also make transfers from your Line of Credit loans if available, to your savings and checking accounts. You may transfer funds to or from your checking account at THE FLORIST FEDERAL CREDIT UNION to or from your checking account at another financial institution via the Automated Clearing House (ACH) (set up by Credit Union staff). There is no limit on the number of transfers from your savings account that are made in person or by mail; or if they are made to make monthly payments on The Florist Federal Credit Union loans, to have funds mailed directly to you. Federal regulations limit the number of certain types of transfers and/or withdrawals you can make from your savings account to six per calendar month. The types of transfers that are limited are those requested by fax, telephone, Internet, and pre-authorized transfers.

 

Transaction Fees

 

THE FLORIST FEDERAL CREDIT UNION does not charge for transfers initiated via THE FLORIST FEDERAL CREDIT Union’s Online Access, viewing account information via the Internet or any other services offered through Online Access. THE FLORIST FEDERAL CREDIT UNION reserves the right to charge for Online Access or other services offered through Online Access. You will be given at least 21 days advance notice before THE FLORIST FEDERAL CREDIT UNION implements any new fees for Online Access services.

 

Periodic Statements

 

You will receive a monthly savings and checking account statement for each month in which you initiate electronic transactions via debit at the point of sale, or Online Access, unless you choose to suppress your statement. At a minimum, you will receive a quarterly savings account statement. Additionally, you can view all of your savings and checking transaction activity through Online Access as well as sign up to receive your statements electronically.

 

Privacy Account Information Disclosure


As a member you have received a privacy disclosure from us. We will disclose information to third parties about your account or the transactions you make:

· If we return checks on your account drawn on non-sufficient funds, or if we are unable to complete an electronic transfer because of non-sufficient funds.

· When it is necessary for completing transfers.

· In order to verify the existence or conditions of your account for a third party, such as a credit bureau or merchant.

· In order to comply with government agency or court orders.

· If you give us your written permission.

· In accordance with our privacy policy.

 

In Case of Errors or Questions About Your Electronic Transfers


If you think your statement or receipt is wrong, or if you need more information about a transaction listed on the statement or receipt, telephone us as soon as possible to 1-575-622-0560. Otherwise, write us at: THE FLORIST FEDERAL CREDIT UNION, PO BOX 2202 ROSWELL NM 88202. We must hear from you no later than 60 days after the FIRST statement on which the problem or error appeared.

· Tell us your name and account number.

· Describe the error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.

· Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send your complaint or question in writing within ten (10) business days. We will notify you of the results of our investigation within ten (10) business days (twenty [20] business days for new accounts) of hearing from you, and we will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will provisionally credit your account within ten (10) business days (twenty [20] business days for new accounts) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. A provisional credit is a temporary credit adjustment made to your account during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may remove the provisional credit from your account. Please note that contacting us by telephone will not preserve your rights.
If it is determined that there was no error, we will send you a written explanation within three (3) business days of completing our investigation, and any provisional credits will be reversed. If you do not have sufficient funds in your account to cover the amount of the provisional credit, the account will be overdrawn, and you will be responsible for payment. You may ask for copies of the documents that we used in our investigation.

THE FLORIST FEDERAL CREDIT UNION Mobile Banking is provided to you by THE FLORIST FEDERAL CREDIT UNION, its affiliates, and any of its direct or indirect subsidiaries. When THE FLORIST FEDERAL CREDITD UNION, its affiliates or subsidiaries hold an Eligible Account or provide an Online Financial Service (“THE FLORIST FEDERAL CREDIT UNION” “we” and “us”), these “Terms of Use” set forth the terms and conditions for use of THE FLORIST FEDERAL CREDIT UNION Mobile Banking service. By accepting this agreement, you agree to all terms, conditions and notices contained or referenced in this Terms of Use, and you are providing your EXPRESS PRIOR CONSENT. Access to and use of THE FLORIST FEDERAL CREDIT UNION Credit Union Mobile Banking service is subject to all applicable federal, state, and local laws and regulations. Unauthorized use of THE FLORIST FEDERAL CREDIT UNION Mobile Banking service or information accessed via THE FLORIST FEDERAL CREDIT UNION Mobile Banking service is strictly prohibited.


Description of THE FLORIST FEDERAL CREDIT UNION Credit Union Mobile Banking
 

THE FLORIST FEDERAL CREDIT UNION Mobile Banking refers generally to any service allowing an existing THE FLORIST FEDERAL CREDIT UNION member to access and view “Eligible Account(s)” from a cell phone or handheld device (collectively, “mobile device”). THE FLORIST FEDERAL CREDIT UNION  Mobile Banking service includes Wireless Application Protocol (WAP). In the event of any inconsistency between prior terms of use applicable to THE FLORIST FEDERAL CREDIT UNION Mobile Banking service and these Terms of Use, these Terms of Use shall apply. Undefined terms herein shall have the meaning assigned to them in the Account Agreement. These Terms of Use supplement the Account Agreement. In the event of an inconsistency between the Account Agreement and these Terms of Use, the Terms of Use shall govern. THE FLORIST FEDERAL CREDIT UNION Mobile Banking service allows you to view balances and track recent account activity on your “Eligible Account(s)” from your mobile device and receive alerts for which you have subscribed.


What Does THE FLORIST FEDERAL CREDIT UNION Credit Union Mobile Banking Include?
 

THE FLORIST FEDERAL CREDIT UNION Mobile Banking includes Wireless Application Protocol (WAP). The Wireless Application Protocol (WAP) is the Mobile Banking website and requires Internet access on your mobile device. The Mobile Banking website allows you to view your account balance, review recent account history, and transfer funds between your accounts. From time to time, THE FLORIST FEDERAL CREDIT UNION may develop additional Mobile Banking services. As such services are developed; you will have the opportunity to add them to your THE FLORIST FEDERAL CREDIT UNION Mobile Banking service, provided you have compatible wireless hardware and software.


How to Register For THE FLORIST FEDERAL CREDIT UNION Credit Union Mobile Banking
 

You must first register for THE FLORIST FEDERAL CREDIT UNION Mobile Banking from a personal computer, not from a mobile device, via the “Mobile Bank Set Up” tab in Online Access. You will be provided with free access to the Mobile Banking website services.(NOT YET AVAILABLE)


Relationship to Other Agreements—Mobile Banking
 

You agree that when you use Mobile Banking Services, you will remain subject to the terms and conditions of all existing agreements with us, and our affiliates. You acknowledge that certain wireless service providers and/or wireless carriers may assess fees, limitations, and/or restrictions which might impact your use of Mobile Banking (for example, your mobile service carrier or provider may impose data usage or text charges for your use of or interaction with Mobile Banking, including downloading the software, receiving or sending Mobile Banking text messages, or other use of your Wireless Device when using the software or other products and services provided by Mobile Banking).You expressly agree that you are solely responsible for all such fees, limitations, and restrictions; and that we may contact you via your wireless device for any purpose concerning your accounts at THE FLORIST FEDERAL CREDIT UNION, including account servicing and collection purposes.

 

e-Notices/Alerts Disclosures

 

By choosing to enroll in the Electronic Notices and Alerts (“e-Notices and e-Alerts”) offering you agree to accept various account related notices by email delivery. Your online e-Notice and e-Alert services may include:
• Certificate Renewal Notice
• Notice of Past Due Payment
• NSF/Overdraft Notice

• Account Balance
• Funds Deposited
• Funds Withdrawn
• Check Cleared


 

You must have an e-mail address on file in order to receive and view e-Notices. Upon agreeing to receive e-Notices online, the paper version(s) will not be mailed to you. You will not have the right to request and receive e-Notices in paper form unless you terminate the e-Notices service in the “e-Notices” section of Online Access . You may withdraw your consent to receive e-Notices or change your e-mail address at any time by using the Online Access” function to un-enroll or edit your e-mail address. It is your responsibility to inform the Credit Union of any change in your e-Notice delivery options and/or e-mail address by updating it yourself. There are no fees or account restrictions for choosing to withdraw your consent for online e-Notices or changing your email address.

 

You must have an e-mail address or mobile phone number (for texts) to receive e-Alerts. Any text message costs charged by your mobile phone provider are your responsibility.
